Bayville Park Blvd Busing
One of the most ridiculous aspects of the public/private/privately maintained roads debate, is the busing ban in the Bayville Park Blvd. area. Again, for efficiency purposes I am posting something already written on the subject to bring people up to speed on the topic, this time through a link to The Locust Valley Leader. Please take the time to read the article before going on. This is another example of confusion and conflict arising out of the incorrect classification of roads. As discussed in my previous entry "The Roads of Bayville" these roads are no longer "private" and probably never were. They are privately maintained roads in the public domain. Even if residents do own the property to the middle of the street, or the whole street, as they do on Shore Rd., after ten years of public use, they become "public streets by prescription". Again the Village plows the streets, has garbage collection routes and in this case has even been involved in resurfacing and installing drainage systems. It should be noted that using equipment or labor supplied by any corporate municipality to maintain or improve private property is illegal (more on this to come).
Add to this the fact that civic associations are not legislative bodies and do not have the powers to pass, let alone enforce laws, and you have a classic case of the tail wagging the dog. Neither the Village nor the school district should have tolerated this.
At this point I am told that the buses are now picking up the children of this development, but for all this time children were forced to walk or be driven to bus stops and homeowners near the designated bus stops were forced to deal with a disproportionate number of children and mini vans obstructing the roads. This is not only inconvenient, but potentially dangerous. In order to prevent future problems, an inventory of the roads should be taken in which each street is classified according to the laws that prevail.

Who told you this? Last I heard the issue was still unresolved.

I mentioned to Barry. Situation is supposedly in a holding pattern. I was told by one of the people affected but I don't have all of the details. From what I understand, the buses are making the rounds and picking kids up. Since they are picking the children up, I believe the lawsuit has been temporarily withdrawn.
Seems you have additional info? Please elaborate..

Last i heard, the elementary bus is going in as it has been for the past 4 yrs. but there is still no MS/HS or private school bus.

I am the new president of the Baville Block Blvd. Ass. A bit of history. Originally the buses could not come in because the school district drove a bus through and it was too dangerous. Then when the roads were redone, a group of elementary parents requested their bus be brought in. It was. Other parents wanted their buses brought in. The passed president held a vote, which was deemed to be illegal, the vote was tabled until more info was gathered. I became president. We are still trying to get a straight answer from some one on what exactly our legal rights are on this matter. If we have no jurisdiction over access, all buses will be brought in AT THE Discretion OF THE DISTRICT!! If we do have jurisdiction we will hold a vote according to our new by-laws. If the vote comes up no buses aloud we will have 4 lawsuits on our hands. I will keep all informed after our Dec. general meeting.

curious, why link to the leaderonline site? why not just tell us what's there?
I've heard negative things about the admin over there checking IP's and such. personally i'm not too keen on visiting that site.

The admin at The Leader forum (to the best of my knowledge), moderates and may block a poster if they are posting abusively. At that point, an IP address may be checked for multiple handles or links to sex sites and such and blocked. Blocking an IP address does not give the Admin information as to whom the IP address belongs to, only a set of numbers and perhaps the carrier like Optimum. An Admin would need a court order to obtain personal info as such as who the IP address belongs to or a person's e-mail.
People like to spread rumors around here. I hope this helps you see the truth of the matter and urge you to browse through a well-visited, and informative site. You should have nothing to fear in terms of posting there, other than a lot of people will be reading your words.
But basically, what the article says is that the Association has produced a letter citing information helpfully posted in this blog regarding NYS Village Law and that the Assoc. does not have say-so over what types of vehicles may traverse its roads since the roads have been open to public services for more than 10 years. LVCSD was officially delivered the letter on 11/22 and as of this posting is still "reviewing" the letter.
The ball is in LVCSD's court. It is my opinion that it is the responsibility of the school district to get its ducks in order so that immediately after the Christmas vacation, the children of the Bayville Park Blvd. area will be able to safely board transportation to their schools.
Enough red tape! Do what is right for the safety of the children.

There's not much to say here because there is nothing but rumor to go on, but the rumor is that St. Gertrudes has sold a piece of land to a developer, that the land is on Dickerson Ave. and that it was sold to Mohring for development.

Over in the St. Gertrude's section, you posted a comment about the "clarification" of the land being sold by the church.
You stated it was not near Dickerson. Now you are saying it is on Dickerson, which is it?

My response above was in response to Admin's question "Where is here?" regarding my statement that "People around here like to spread rumors". I was pointing out the Bayville Blog's own statement:

.....and forgot to put quotation marks around it. The property in question IS NOT on Dickerson Avenue.

Barry was merely stating that there was a rumor already out there, if that is what you are referring to.
To have a dialog on something is not quite "spreading a rumor". After all this is an open blog. Censorship is not practiced on this site as long as the posts are in good taste. Please stay on topic as you are posting this info under the incorrect entry if it was truly related to the St Gerts post.
