Reminder - Vote on the NCPD Antenna Project April 23rd 7:30PM

APRIL 23rd, during a regular meeting the Village of Bayville board will vote on the Police Cell Tower project.

It is very important that people concerned with this project show their face. The Mayor has been qouted in a local paper as saying, there is diminishing opposition for the project because less people were at the second meeting.

Even if you sent a letter, made a call to Village HAll or signed a petition....you need to show up to show your opposition. Packing VH like the residents did at the first meeting, obviously makes a difference to the board.

Stand up for the children....we are their last line of defense.
Thank you.

Margaret

Take note of all the new green steel at the base of the water tower. They are green brackets painted the same color as the water tower, they appear to be ready for intallation on our water tower. Besides the police has one of our current tenants decided to add more antenna's, if so we have no control over that cause Vicky and the board signed lopsided leases, only favorable to the wireless companies and unfavorable to the citizens of this village.

"The apparatus proposed would be part of a larger network, intended to improve first responder communications throughout Long Island. The Bayville Fire Department, County Executive Tom Suozzi, Nassau County Police Commissioner James Lawrence and others insist that enhancing public safety demands the system’s installation on every site requested."

The "First responders" benefiting from the current proposal will indirectly include the Fire Departments across Nassau County.

Even though they would be provided “space” on the new system, the FD’s would still have to purchase very expensive equipment from Motorola, and in the case of the Bayville Fire Co (since this is the Bayville blog), it would not provide the critically needed interoperability between the different departments. Each of the departments in the county would have to purchase this equipment since they were never included in the grant for the proposed system. Poor planning by Nassau County?

One question. If this is equipment for either the Bayville Fire House add-on project or the actual police antennae project, wither way, didn't somebody jump the gun???? The VOTE is tonight, unless others have already made a decision and the public hearing is a joke.

What concerns me is if those brackets are for "other" towers that are under the commercial contracts we already have with the existing communication companies. Guess we will find out tonight.

When will the tower be filled to capacity? When will enough be enough?

At this point there should be nothing else added to this tower until there is a decision on the NCPD proposal.
Can a motion be made to not allow additional transmitters/recievers tonight at the meeting? Are the commercial cell agreements open ended without restrictions? That would seem foolish on the part of the village.

Jeff - I believe you also have to consider the telecommunications act in addition to any written agreements between the Village and Motorola, if any. The Telecommunications Act (TCA) of 1996 states the following, in part:

(iii) Any decision by a State or local government or instrumentality thereof to deny a request to place, construct, or modify personal wireless service facilities shall be in writing and supported by substantial evidence contained in a written record.

(iv) No State or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions.

Thus it appears that the Village would have to submit substantial evidence as to why it was limiting the number - are there any local ordinances addressing the use of the water tower that could be cited as a reason to bar additional transmitters or receivers? You may want to take a look at that possibility.

Well the deed of the property says NO COMMERCIAL ENTERPRISES - that don't count though, why-cause counsel says so. Maybe someone should get a second opinion.

The cell towers should not have been allowed at all by Esposito and Siegel should have fixed it and could have moved in that direction tonight. Instead our Mayor and officials hide behind lawyers and vague, defensive statements. Notice the first 4 words at todays vote - "Upon reccomendation of counsel" gee-sounds the same as their decision in '93. I think we need new village counsel. Do I sound glib? so sorry- I learned it from Cotten.

Here's another big one (you know - like asbestos and cigerettes and paint) many scientists didn't pay attention to global warming and rising seas. Well now they are.

But the big concern is storm damage now...Hey - let's dredge the sound - get the Army Corp! Open the beaches to non-residents! That should fix it for another few years. how about a moretorium on the houses being built on the shore? how about stop extending the beachfront homes OVER THE DUNES? naaah - then we wont get the tax dollars!

And 202,000 dollars a year in revenue from the cell towers? Better sock it away for the lawsuits in 10 years. Or maybe donate for leukemia research.
Actually never mind, the board made their decisions "on reccomendation of counsel"- the get out of jail free card!! Hope Mayor Siegel and the board can sleep at night.

Possibly the Deed could limit any new placement of cell type devices? Can anyone shed some light on this?

In light of tonight's vote to place yet more cell technology on our water tower, I thought this article fitting.

The gist of it is that bee hives across europe and North America are dying off and they are linking it to cell phone waves.

what else could it be harming????

One can find plenty of propaganda in the media. The above is just another example of Left-wing environmentalist scare tactics attempting to supercede common sense and technological progress.

If you can tell me that you don't own a cell phone, wireless Internet or microwave oven..... and don't care if you are protected by First Responders in an emergency, then I respect your position. If not, (as I suspect), then your argument is a red herring.

just ignore her, that post should be disregarded, hey, it reminds me of vicki's whining last night. Don't be a public figure if you don't want the responsibility and save the woah is me in my "electric chair" act - noone buys it any more.

If you can't find a real answer then blame the person you dont agree with, kind of like how our Mayor last night quoted her answer of years ago..."do you want it on your private beach?" ..not really an answer...like I said vague and defensive. It's the boards job to figure out where the antennas should go, not residents.

Yes we KNOW it will be controversial anywhere, but that's what the board has to deal with and hopefully find something LESS controversial and MORE ACCEPTABLE TO EVERYONE. The Mayor and the board should pay attention to Mrs DGinarro's VERY REASONABLE REQUEST.
