Village of Bayville Board of Trustees Meeting 11/14/2011

Open conversation following the Regular  Public Meeting of the Village of Bayville Board of Trustees.

BAYVILLE VILLAGE BOARD MEETING Nov 14, 2011  7:30 pm

MEETING SUMMARY:  (compiled by resident attendee)

Business Motions of Village Board:

  • Resolution to  authorize Building Inspector to begin code Chapter 15 (condemned or unsafe structure) on 22 Bayville Ave, old Pig n Whistle location where currently concrete framing sits behind fencing.  First step in getting property cleaned up.  May include determination of unsafe structure.  Owner will be notified with timeframe for remedy.  If not remedied, fines or other measures will ensue.
  • Resolution to continue participation in ongoing Nassau County program of Community Development Block Grant Program to assist homeowners who meet certain income criteria with necessary home improvements.
  • Resolution to honor the Village mandated audit for the courts.
  • Resolution to hire beach attendant at $7.50 hour.
  • Resolution for a change order to the Streetscape Project (Ludlam Ave), cost of $62,000 within original budgeted frame (which came in below initial cost estimates),  based on past three years weather, tree, fencing conditions since first plans were drawn up 3 years ago.  More sidewalk to be included in renovation.   One resident complaint that he was not personally notified as to the project and schedule, and his property borders on the project areas.

 

Public Comment:  The Mayor opened up Public Comment announcing that since September 26th public comment time ran over 2.5 hours, and that did not serve anyone, he will limit Public Comment tonight to 30 minutes.

  • Resident disappointed that after Library construction project there were many empty shelves, not very much more books, and very low attendance at toddler story time, since Library newsletter was discontinued.  A request was made to add a Library news insert into the quarterly Village newsletter.
  • Over the Bridge storeowner reminded and requested of Bayville to shop locally, and gave dates of Wine Tasting event on Nov 18, and the countywide program of Small Business Saturday on Nov 26.  The comment was of very low traffic in her store in town.
  • Arlington Lane resident asked for response from Maria Alfano-Hardy on two road questions regarding private roads and maintenance.  Since the Village Board has not me in regular session since September 26 they had not discussed answers, but will have answers at next Village Board Meeting.
  • A resident commented that he was not pleased with Board’s vote to settle the Fire Company budget lawsuit with a vote to meet full request of Fire Company budget.  Trustee Staab gave several detailed points on the considerations that went into that settlement decision such as cost of long lawsuit, relationship with Fire Company, parameters to other two Villages served by Fire Company, and getting second year at no increase.  Discussion of these considerations were limited at Oct 25th Public Hearing because lawsuit was not yet closed.
  • Resident  complaining on past issue of suspected polluted water effluent from neighboring property.  Resident thanked Village Board for pressure put to business that was pumping out front to sidewalk and road in front of another restaurant.  Sidewalk outflow was removed and piped underground to street drain.  Several water tests were made, and Mayor and resident discussed the water test reports of fecal coliform ppm and that while not drinking water, the water was not sewage.
  • Resident asked about 2011 budget line item for Fire Company, of $25,000.  Mayor explained that the money was a short term transfer to buy a 6-wheel dune buggy for the Fire Company but that state grant money obtained by the Fire Company was then used to pay back the Village
  • 8 residents from Oak Neck Point asked of Village Attorney about the repair responsibility of the brick wall along their neighborhood and Bayville Avenue.  Village letter went out to Association that Oak Neck Point Association is responsible for wall. But no action of repair taken. Village Attorney Bianco is working on further research and will have more information on possible remedies, of which Chapter 15 or unsafe structure does not seem to be a viable mechanism in this case.
  • Resident spoke out that incidence of unkind letters and emails to Village government members is awful and unacceptable, and she hopes investigation finds the culprit.
  • Resident commented on current construction at Streetscape Project and thanked both current and past Village administrations for their work in securing this project with grant funds for Bayville, and the progress is appreciated.
  • Resident thanked Village Board for proceeding in Chapter 15 to remedy 22 Bayville Avenue, and asked specifically what fines were available if remedy not made, and the answer was most likely the $250.00 per day fine.
  • Resident asked how many violation were issued in recent months, how many of these were dismissed, and how many were rectified.
  • Resident asked again about free running chickens on her street, and asked again for an answer as to code violation on this.
  • Senior Citizen resident gave an emotional plea to Board to see the upsetting decline in Bayville neighborhoods, house near him with four families, unkempt homes.  He recognized the beautiful nature of Bayville, residents, and participants who come here tonight.

I do think mention needs to be made that pretty much the entire room full of residents was not happy with the limiting of public commentary. To me, and maybe it's the history nerd deep inside, these meetings are a microcosm of democracy and the ability/privilege ot stand up in front of your peers and speak with your elected officials is the most american of experiences.

    Perhaps it would have been better if Mayor W would have proposed a limit on public commentary for future meetings, or even put forth an amendment to village code saying that there will only be 30 min of commentary at each one. OR that ppl who want to speak have to contact village hall the day of the meeting to get put onto the meetings agenda? or something like that.

    simply declaring a 30 min limit is, well, limiting! and kind of insulting to those who made the effort to attend with ideas/comments/suggestions about how to make our village a better place to live.

    In the Town that we reside in (Town of Oyster Bay) a meeting attendee who wishes to speak that night must sign in to a speaker list before the meeting begins. Then if time allows, others speak too. Never saw it limited myself.

    My husband's job is to make presentations before village and town boards, (zoning boards, architecture review boards) and these villages of the north shore will hash it out until 10 pm regularly, 11 pm occasionally, and midnight is once is a great while. They consider the time their own villages' best interest.

    I think that the most important thing at the moment in this Village is to issue violations to those in violation of our Village codes and either force their corrections or collect the fines.

    Our Village is in the red prior to amending the budget to give the FD more money. We need the revenue income, and violation fines are the way that municipalities can generate revenue.

    By issuing these fines, people can avoid the fines by correcting their infringements on the code. This would also help the Village become a more aesthetically pleasing place. Commercial districts would be improved at the cost of the property owners , not the taxpayer and residential areas would improve the quality of life and home values of those around the homes that continually violate the codes here.

    Give violations, do not dismiss them at court level force the people to rectify the problems or collect the fines...it is that simple.

    Guys working on Ludlam and Bayville ave, doing a great job, traffic moving well, working at a nice pace. Thinking we should tell them as we drive by during the day?

    See you tomorrow night, i'm still wondering why evryone one got those new pretty street signs what was it 2 yrs ago? and 2 bocks in my area didn't? my street and another.... did we not matter we still have those ugly green things.
